Terms of Order (Custom Painting)

1. Order
Each custom painting is created individually based on the description, inspiration, or reference material provided by the client. The composition and execution are made exclusively for that order and are not reproduced.
2. Deposit
Once the concept is approved, a deposit of 25% of the total value is required. The remaining 75% is due before shipping or collection of the finished work.
3. Delivery time
Estimated delivery time: 4–8 weeks, depending on size and complexity. This timeframe is indicative; exceeding it does not entitle the client to compensation.
4. Right of withdrawal
Because the painting is made according to the client's individual specifications and cannot be resold, once the concept has been approved and the deposit paid, the statutory 14-day right of withdrawal does not apply (Article 6:230p Dutch Civil Code). This is communicated to the client before the order is confirmed — ideally in writing (email), before the deposit is requested. Cancellation before the concept is approved is possible without consequence.
5. Liability
Liability is limited to the value of the order, except for damage resulting from intent or gross negligence.
6. Copyright
Copyright of the work remains with the artist. Photos of the finished work may be used for portfolio/promotional purposes, unless otherwise agreed.
7. Personal data
Data collected: name, email, information needed to fulfil and ship the order.
Purpose: solely to process the order and related communication — never used for marketing without consent.
Retention: as long as needed to complete the order and meet any tax obligations.
Client's rights: access, rectification, erasure, restriction of processing, objection, data portability, and the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
